Acceptance of Terms
 

By accessing www.houstonhatguy.com and utilizing our services, you agree to comply with and be bound by these Terms & Conditions. These terms apply to all site visitors and customers.
 

Intellectual Property
 

All content on this site—including names, logos, images, text, videos, and product designs—is the intellectual property of Houston Hat Guy LLC and is protected by copyright, trademark, and other applicable laws. Houston Hat Guy LLC retains all rights to photographs and digital representations, and to the names and descriptions of the hats created by Lawrence Jagneaux, including for custom hats that have been commissioned, for marketing and promotional purposes.
 

Ordering and Payment Terms

  • Hat Shop (Pre-orders): For hats listed with a specific price in the Hat Shop, 100% of the listed price is due upfront at the time of the order. Any requested modifications to these designs may result in additional charges, which must be paid in full before the hat is shipped or picked up.

  • Personalized Hat Service: There is no initial cost to submit an inquiry to begin the design process. Once the design process officially commences, a 50% deposit is required. The remaining balance must be paid in full prior to shipping or local pickup.

User-Provided Content
 

When providing logos, brands, or images for fire or laser branding, the customer represents and warrants that they own the legal rights to said designs. By submitting content, you agree to indemnify Houston Hat Guy LLC against any claims of intellectual property infringement. We reserve the right to refuse any design that appears to violate trademark laws.

Title, Risk of Loss, and Liability

  • In-Person Pickups: Title and risk of loss transfers to the customer at the point of pickup. If no issues are raised at the time of the exchange, the hat is considered accepted "as is."

  • Shipping: For shipped orders, title and risk of loss transfers to the customer when the item is turned over to the United States Postal Service (USPS). The cost of shipping insurance is included in the final delivery fee to protect the value of the shipment.

  • Satisfaction: In accordance with our Refund Policy, all sales are final. However, in either scenario above, Houston Hat Guy LLC will make every effort to work with the customer to resolve concerns or correct issues to the best of our ability.
     

Limitation of Liability

Since every hat is made by hand, no two are exactly the same. Even if you order a design from the website, yours might look a little different. These variations happen because of the natural materials available or the unique way each hat is crafted. This ensures your hat is truly one-of-a-kind.

As Houston Hat Guy LLC products are handcrafted from natural materials, minor variations in color, texture, and grain are inherent to the craft and are not considered defects. Houston Hat Guy LLC is not liable for damage resulting from improper hat care, environmental exposure, or normal wear and tear after the transfer of title.

Governing Law


Any disputes or legal proceedings arising from these Terms & Conditions or the use of this website shall be governed by the laws of the State of Texas and shall be subject to the exclusive jurisdiction of the courts in Harris County, Texas.
